Who Needs Workers' Comp in Massachusetts?
Massachusetts requires all employers to carry workers' compensation insurance under M.G.L. Chapter 152. Coverage is required for any employer with one or more employees, including part-time, seasonal, and temporary workers. There are virtually no exceptions — even domestic employers who hire household workers for 16+ hours per week must provide coverage.
Penalties for Non-Compliance
Massachusetts penalties are severe. Operating without coverage is a criminal offense punishable by fines up to $1,500 and/or imprisonment up to one year for a first offense. The state can issue stop-work orders and assess penalties of $100 per day of non-compliance. Repeat offenses carry fines up to $10,000 and imprisonment up to five years. Employers are personally liable for all injury costs.
How Massachusetts Rates Work
Massachusetts has its own independent rating bureau — the Workers' Compensation Rating and Inspection Bureau of Massachusetts (WCRIBMA). The bureau establishes class codes and advisory rates specific to Massachusetts. Carriers can deviate from these advisory rates, which makes comparing quotes from multiple carriers especially important. Massachusetts rates are moderate compared to neighboring northeastern states.
