Who Needs Workers' Comp in Nevada?
Nevada requires all employers with one or more employees to carry workers' compensation insurance under Nevada Revised Statutes Chapter 616A-D. This applies to all employees including part-time, temporary, and seasonal workers. Sole proprietors can elect coverage but are not required to carry it.
Penalties for Non-Compliance
Nevada has some of the harshest penalties for non-compliance. Fines can reach $15,000, with criminal penalties escalating from a gross misdemeanor for a first offense to a Category E felony for subsequent violations. The state can issue immediate stop-work orders. Employers are liable for all injury costs plus penalties of up to 150% of the premium that would have been charged.

Nevada transitioned from a monopolistic state fund to a competitive market in 1999. Employers Insurance Company of Nevada (EICN) remains a major carrier.
